I received dui drugs less safe and possession of marijuana charges and was court ordered by the state to 2 years of probation, 24 hours jail time, 80 hours community service, $ 2000 in fines, and to complete a drug and alcohol evaluation. I had the option of non reporting probation after 1 year granted I had completed everything on the order. After completing the evaluation I was assigned 17 weeks of class for drug and alcohol treatment and but the rules of attendance stipulate that if I miss more than 2 class I simply have to attend an additional class along with making up the initial class. I cannot afford the classes and have had to miss way too many. I completed the original 17 along with an additional 8 but am still a long way from completing the program due to attendance. I haven’t violated probation, rules of the program, or failed any drug and alcohol screens. Those are the details so my question basically is, if i set up a time to go before the judge is it likely that he will find my financial situation grounds for variation in that the attendance I have will suffice and place me on non reporting probation or even allow me to leave the program. I haven’t done any drugs for over 1 and a half years and hope to enlist after probation is over. I would really appreciate some in-site from any persons with a substantial legal opinion specifically on criminal law, court, or probation in Georgia. Thanks for your time

You could, and should, talk to your original Probation Officer about this. Most Judges will not modify a sentence once it is given, especially since probation violations have already occurred.
