Question by : What are my rights when wanting to move out of state with kids?
My husband told me he’s leaving me. That he no longer loves me. I am very hurt about it. But now I trying to finger out where to go now. I use to live in New York but now live in Columbus, Ohio. I want to move back to NY because my grandma will help me to get on feet. But I know he will not let me leave with our two kids. By law what are my rights

He is leaving you, so you have the “moral” high-ground, and you are the mother, which will weigh a lot in court. He is the guy that walked away from his family. Doesn’t look good in society, or in a courtroom. If you play your cards right, you might be able to take his child-support money and run.

However, if you have a history of child-abuse, or drug use, a criminal record, bankruptcy or crap like that there is a good chance that he will get at least partial custody. Then you are stuck.

If you suffer from mental illness, that can be a strike against you, but your husband would be leaving his mentally-ill wife, which is a strike against him.

It all depends on the situation. Unless he really has his sh!+ together, and you don’t, the court should rule in your favor.
