Question by amanda: Can i leave the state with my child and without my partner?
My partner and I recently had a son, however my partner has developed a drug problem and needs to go to treatment. I want to take my child to Texas to stay with my mother while he is gone because my partner has spent all of our money and put us in dire financial straits and because I need additional help with my son. Because he has wiped out our bank accounts it I don’t go to Texas we will be out of a place to live very soon. My family has agreed to pay for us to move there but will not help to keep us in Washington because of his drug addiction. We are unmarried but he is the legal father. He agrees that we should go to Texas so that I can have help with the baby and in fact had been planning to move there anyway so that I could attend graduate school. He plans on joining us ss soon as I find a house and a teaching position and he finishes drug treatment. My question is whether or not this is legal without a court affidavit documenting his permission and if its not, then what is the likelihood of repercussions since he would never file for abandonment or kidnapping?

BC you arent married you can do whatever you want. you wouldnt be charged with kidnapping. his first course of action would be to petition for custody. keep his drug problems documented for something to keep in your back packet.
